Legal Resources > NJ HOA Taskforce (1997-1998)

In 1997, the NJ Legislature Enacted an Assembly Task Force to Study HOAs.

The Task Force was made up of three Legislators (Bateman, Gregg, and Wisniewski), one Developer's Attorney, one Managing agent, two CAI attorneys, and two members who were Board Members of their HOA's (unfortunately, hardly representative of the interests of the individual homeowners). The Task Force held hearings around the state and it quickly became clear that problems were occurring in homeowner associations throughout the state.

Common abuses and injustices included such things as: boards were conducting all association business behind closed doors; boards were refusing to let homeowners see basic financial records and meeting minutes of the association; boards were making up rules without homeowner input; boards were controlling (rigging) elections; and boards were making large purchases without approval of homeowners. It became apparent that it is the boards that can do the big damage because they have been granted powers without oversight.

Needless to say, The Task Force made some startling discoveries, and also made some very over due, and very important recommendations. Click on the link below to read the officail task force findings which lead us up to where we stand today, defending the rights of Homeowners on the NJ Senate floor with bill S-2016.
